Notice of motion to the respondents No.1 and 2 only.
On the asking of Court, Shri Rajeev Sharma, Standing Counsel appearing for the Union of India accepts notice on behalf of the said respondents.
Copies of the writ petition have been supplied to the learned counsel for the respondents.
The petitioners have approached this Court for issuance of direction to the respondents to release the payment of compensation amount qua the land of the petitioners which, according to the petitioners, had been acquired by the said respondents.
After hearing the learned counsel for the petitioners and taking into consideration the various pleas raised by them in the petition, we find that the petitioners should first approach the Defence Estate Officer, Punjab Region, Jalandhar, respondent No.2 by filing
individual and detailed representations making the claim which has been made by the petitioners before this Court.
In this view of the matter, without going into the merits of the claim made by the petitioners, we dispose of the present petition with a liberty to the petitioners to file individual and detailed representations before the Defence Estate Officer, Punjab Region, Jalandhar, respondent No.2 within a period of four weeks from the date a certified copy of this order is received. In the aforesaid representations, the petitioners shall give all the necessary details with regard to their land and the claim made by them qua compensation. On receipt of the aforesaid representations, Defence Estate Officer, Punjab Region, Jalandhar, respondent No.2 shall take a final decision on the aforesaid representations, by passing a detailed and speaking order within a period of four months from the date of filing of the representations.
A copy of the order be given dasti on payment of usual charges.
