Suresh & Ors v. State of Haryana & Ors - CWP-13529-2006 [2006] RD-P&H 5656 (21 August 2006)

IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

CWP NO.13529 of 2006

DATE OF DECISION: August 28,2006

Suresh and others

....Petitioners

VERSUS

State of Haryana and others

.....Respondents

CORAM:- HON'BLE MR. JUSTICE VINEY MITTAL
HON'BLE MR. JUSTICE H.S.BHALLA

PRESENT: Shri Pankaj Nanhera, Advocate for the petitioners.

Viney Mittal,J.(Oral).

The petitioners have approached this Court for issuance of some directions to the respondents. Additionally, a prayer has been made that the petitioners be allowed alternative plots.

From the perusal of the record, we find that before approaching this Court, the petitioners have not approached the respondents by issuing any notice of demand of justice. It is well settled that before seeking a writ of mandamus, a person is required to approach the competent authorities seeking the necessary relief.

Consequently, we find that the present petition is pre- mature.

Dismissed as pre mature.

However, the petitioners may approach the respondents seeking the requisite relief at the first instance.
