Notice of motion to the respondents.

On the asking of the Court, Sh. Ashok Aggarwal, Additional Advocate General, Punjab accepts notice on behalf of the respondents.

A copy of the writ petition be supplied to Mr. Aggarwal by the counsel for the petitioners.

We have heard learned counsel for the parties. The petitioners have approached this Court challenging recovery orders dated June 8, 2006 (Annexures P-1 to P-4)

The primary grievance of the petitioner is since the aforesaid recovery orders have been passed against the petitioners without affording any opportunity of hearing to them and without ever serving any show causes notices in this regard.

From the perusal of the orders Annexures P-1 to P-4, we are satisfied that the grievance of the petitioners is wholly justified. In this view of the matter, without going into the merits of the claim made by the petitioners, we allow the present petition and quash the orders Annexures P- 1 to P-4. However, the respondents would be at liberty to pass fresh orders against the petitioners, if so advised after serving a show cause notice on the petitioners at the first instance.

The present petition is disposed of accordingly.

Copy of the order be given dasti on payment of the usual charges.
