Notice of motion to respondent no.1 only, at this stage. Mr.

Gurinder Singh, Advocate accepts notice on behalf of respondent no.1.

Copy of the writ petition be supplied to the counsel for respondent no.1 by the counsel for the petitioners.

The petitioenrs have approached this Court for the issuance of directions for setting aside a decision taken by the University on September 13, 2001 to the extent that the said decision has been made operative retrosepectively. Learned counsel for the petitioners have relied upon a judgement dated May 16, 2006 passed by a Division Bench in this Court in LPA No.30 of 2006, titled as "Munish Kumar Talwar Vs. The Vice C.W.P NO. 12509 OF 2006 2

Chancellor, Baba Frid University of Health Sciences and others". A copy of the judgement has been appended as Annexure P-3 with the present writ petition.

From the perusal of the record, we find that the petitioenrs have already filed a representation dated August 7, 2006 (Annexure P-4) which remains unresponded so far.

In this view of the matter, without going into the merits of the claim made by the petitioner, we dispose of the present petition with a direction to respondent no.1-University to take a final decision on the aforesaid representation filed by the petitioners within a period of 2 weeks from the date a certified copy of this order is received keepin in view the law laid down in Munish Kumar Talwar's case.

In case any order adverse to the petitioenrs is passed, the petitioners would be at liberty to approach this Court yet again.

Copy of the order be given dasti on payment of the usual charges.
