The petitioner is aggrieved against the action of the respondents, whereby according to the petitioner, interest has been charged in violation of the provisions of HUDA and the law laid down by a Division Bench judgement of this Court in Gian Inder Sharma Vs. HUDA, CWP No.16497 OF 2001 decided on November 11, 2002.
Keeping in view the plea raised by the petitioner, but without commenting thereupon, in any manner, we dispose of the present petition with a direction to the Estate Officer, HUDA, Karnal to take a final decision C.W.P NO. 17968 OF 2005 2
upon the grievance made by the petitioner.
For this purpose, the petitioner shall be required to file a detailed and comprehensive representation within a period of 4 weeks from the date a certified copy of this order is received by appending all the necessary documents. On receipt of the aforesaid representation, the Estate Officer, HUDA, Karnal shall take a final decision thereupon within a period of 4 months keeping in view the law laid down in Gian Inder Sharma's case by passing a detailed and speaking order.
Copy of the C.W.P NO. 17968 OF 2005order be given dasti on payment of the usual charges.
