The primary grievance made by the learned counsel for the petitioners is that although vide an order dated October 2, 2004, the revision petition filed by the petitioner was disposed of by the Financial Commissioner and Secretary to Government of Haryana with a direction to the petitioner to clear all the outstanding dues, in the question with regard to the non-delivery of possession was to be examined by an Estate Officer, but no decision has been taken by the Estate Officer so far. Learned counsel for the petitioners further informs the Court that the petitioners have since C.W.P NO. 19005 OF 2004 [2]

deposited all the outstanding dues as were required to be deposited vide aforesaid order dated October 2, 2004.

Learned counsel appearing for the respondents does not dispute the fact that the entire amount has since been deposited but it is pointed out by him that there was a delay in depositing the aforesaid amount. Learned counsel for the respondents further maintains that the necessary enquiry as per directions dated October 2 2004 shall be completed by the Estate Officer, HUDA, Gurgaon within a period of 4 months.

In view of the aforesaid stand taken by learned counsel for the respondents, we dispose of the present petition with a direction to the Estate Officer, HUDA, Gurgaon to take a final decision in the enquiry proceedings pending in the case of the petitioner in terms of the directions dated October 2, 2004 passed by the Financial Commissioner, within a period of four months from the date a certified copy of this order is received.

Copy of the order be given dasti on payment of the usual charges.
