The petitioners apprehending their arrest in a non-bailable offence in case FIR No.33 dated 10.3.2006 registered under Sections 498A/406/506 IPC at Police Station City, Fazilka, District Ferozepur, have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.
I have heard the counsel for the parties.
In this case, counsel for the petitioners has placed on record the copy of the letter dated 25.7.2006 sent by the Inspector General of Police, Zone Bathinda to the Senior Superintendent of Police, Ferozepur, according to which, the report submitted by the D.I.G., Bathinda Range was accepted and the police is directed to submit the cancellation report to the court.
While referring to Annexures P-11 and P-12, counsel for the petitioners pointed out that all the dowry articles which were recovered by the police from the accused have been returned to the complainant. Counsel further contends that in terms of the interim order dated April 20, 2006, the petitioners have joined the investigation. This fact has not been disputed by the State counsel.
In view of the above, the interim order dated April 20, 2006 is made absolute on the same terms and conditions.
