Petitioner Jaswinder Singh @ Jassi apprehending his arrest in a non-bailable offence in case FIR No.30 dated 18.3.2006 registered under Sections 420/406 IPC at Police Station Kartarpur, Distt. Jalandhar, has filed this petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail.
I have heard the counsel for the parties.
Counsel for the petitioner contends that in view of the documents Annexures P-1 and P-2, the allegations levelled by the complainant are apparently false. Counsel further contends that the documents Annexures P-1 and P-2 clearly reveal that the complainant was taking different stand. He also contends that in terms of the interim order dated May 5, 2006, the petitioner has joined the investigation.
In view of the aforesaid, the interim order dated May 5, 2006 is made absolute on the same terms and conditions.
This bail order shall remain in operation till the investigation culminates into filing of challan under Section 173 Cr.P.C. except for material change in the circumstances. Thereafter he shall be entitled to the grant of regular bail by the trial Court and the same shall further continue till conclusion of the trial on the conditions to be imposed by the court of competent jurisdiction.
