This writ petition has been filed against the order dated September 28, 2005, Annexure P-3, vide which appeal, filed by respondent No. 3, against his removal from the post of Sarpanch was allowed by the competent authority. The dispute is as to whether one Shri Amar Singh has taken illegal possession of the land, which , as per version of the petitioner, was a part and parcel of the village pond. It was allegation against respondent No. 3 that being a relative, he has not initiated any action against Amar Singh. It was noticed by the appellate authority that the ejectment application has already been filed. Shri Chhina states that the said application is pending before the competent authority.
In view of facts, mentioned above, no case is made out for interference. Dismissed.
