The challenge in the present revision petition is to the order passed by the learned trial Court on 10.02.2005 whereby Rs.1200/- per month was awarded as maintenance pendente lite and Rs.1500/- per month as litigation expenses.
The learned trial Court has found that the petitioner is an able bodied person and running a hardware shop and that his income can safely be presumed at Rs.3000/- per month.
I do not find any patent illegality in the income so assessed by the learned trial Court which may warrant interference by this Court. On the basis of said assessment, the grant of maintenance pendente lite at Rs.1200/- cannot be said to be excessive in any manner. However, grant of Rs.1500/- per month as litigation expenses appears to be on account of typographical mistake. In fact, litigation expenses are payable once only.
With the said modification, revision petition stands disposed of.
