Affidavit filed by Mr. Rachhpal Singh, Deputy Supdt. of Police, City-II, Amritsar is taken on record.
Learned counsel for the petitioner has stated that vide order dated March 23, 2004, this Court rejected the bail application of the petitioner. Since then no application for bail was filed, apart from one which has been filed today.
More than 2 years and 5 months have passed since the bail order was passed, but in this period the prosecution has examined only 14 witnesses out of 27 cited by them.
Learned counsel for the State has argued that the case before trial Court will be expedited as the prosecution is willing to get the remaining witnesses into the witness box.
The petitioner is in judicial custody for about 3 years and 6 months.
Though there is an order dated March 23, 2004 which has been passed on merit by this Court, but a lot of time has elapsed since then and till date, the prosecution has examined only 14 witnesses out of 27.
Bail is granted to petitioner- Jasbir Singh to the satisfaction of the trial Court.
