IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH.

Crl. Misc. No. 53212-M of 2006

DATE OF DECISION : 07.09.2006

Sarabjit Singh

.... PETITIONER

Versus

State of Punjab

..... RESPONDENT

CORAM :- HON'BLE MR. JUSTICE SATISH KUMAR MITTAL
Present: Ms. G.K. Mann, Advocate,

for the petitioner.

* * *

Petitioner Sarabjit Singh, apprehending his arrest in a non- bailable offence in case FIR No. 73 dated 21.6.2006 under Sections 326, 323, 34 IPC and Section 452 IPC added lateron, registered at Police Station Ajnala, District Amritsar.

I have heard counsel for the petitioner and gone through the contents of the FIR as well as the order dated 24.8.2006, passed by Additional Sessions Judge, Amritsar, whereby bail application of the petitioner has been dismissed.

In this case, the petitioner is alleged to have given a kirpan blow, which chopped off the right hand little finger of the complainant.

Keeping in view this injury, which falls under Section 326 IPC, I am not inclined to grant anticipatory bail to the petitioner.

Dismissed.
