C.W.P. No. 14180 of 2006
Date of Decision: September 7, 2006
State of Haryana and others
CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
HON'BLE MR. JUSTICE M.M.S. BEDI
PRESENT: Mr. Raj Mohan Singh, Advocate,
for the petitioner.
M.M. KUMAR, J. (Oral)
The instant petition is directed against the cancellation of transfer order by passing order dated 31.8.2006 (P-5). Before approaching this Court the petitioner has not made any representation to respondent Nos. 2 and 3 by bringing to their notice that the policy instructions providing guidelines for transfer have been violated by the impugned order. Therefore, we deem it just and appropriate to relegate the petitioner to the remedy of filing representation before respondent Nos. 2 and 3 by brining to their notice all the grounds taken in this petition showing that the policy instructions providing guidelines for transfer have been violated. Let a representation be made under a Registered A.D. cover within a period of two weeks and if that be done then respondent Nos. 2 and 3 shall pass a speaking CWP No. 14180 of 2006
order on the representation made by the petitioner within a period of four weeks from the date of receipt of the representation.
The writ petition stands disposed of in the above terms.
