This is fourth petition filed by the petitioner Sanjiv Kumar for the grant of regular bail in case FIR No. 103 dated 8.7.2004 registered under Section 18/61/85 of the NDPS Act, registered at Police Station A-Division, Amritsar. His earlier three petitions were dismissed by this Court on November 2, 2004, March 4, 2005 and May 18, 2006. The fact regarding dismissal of the last two petitions has not been disclosed by the petitioner.
I have heard counsel for the parties and gone through the contents of the FIR.
As per the allegations in the FIR, 2.5 Kgs. of opium was recovered from the petitioner at the spot. Counsel for the respondent-State, after having instructions from HC Sukhraj Singh, states that almost all the prosecution witnesses have been examined and only three witnesses remain to be examined, who will be examined within three months.
In view of the aforesaid facts, I do not find any ground to grant the concession of regular bail to the petitioner.
Dismissed.
However, the trial court is directed to expedite the trial.
