The case of the petitioner for compassionate appointment has been considered by the respondents, vide order dated 2.6.2006 (P-4) while deciding her legal notice. According to the view taken by the respondents the petitioner was entitled to be considered for appointment to the post of Assistant Line Man (ALM). There are 140 posts available but she did not fulfil the technical qualification of two years ITI Diploma in Electrical/Wireman Trade. Therefore, the post of ALM could not be offered to her. With regard to the post of Lower Divisional Clerk (LDC) it has been observed that no vacancy is available and moreover the candidates were required to have qualification of at least one year Diploma Course of Computer from CWP No. 14367 of 2006

any institution recognised by the State Government and Data Punching Speed of 8000 keys depression per hour on computer. The petitioner had submitted a certificate of Diploma of Computer Application (DCA) for 12 months from a private agency. Thus, even for the post of LDC she has not been found to be eligible and the vacancy is not available.

Having heard the learned counsel, we are of the considered view that the respondents have duly considered the case of the petitioner for offering her appointment on compassionate ground on account of death of her father on 2.2.2003. It is misfortune of the petitioner that she does not fulfil the educational qualification for the post of Assistant Line Man. The post of Lower Division Clerk is not available although some qualification even in respect of the later post are not possessed by the petitioner.

In view of the above, we dismiss the writ petition.
