The present appeal was adjourned sine die on January 19, 2001.
Earllier thereto also, no one has put in appearance on behalf of the appellant on various dates fixed before the court. Consequently, the appeal was ordered to be listed for motion hearing on November 11, 2005. On the aforesaid date also, no one put in appearance on behalf of the appellant.
Appeal was, accordingly, adjourned for arguments for today. No one appears today as well.
I have gone through the record of the case .
Defendant Ajit Singh has approached this Court through the present appeal. He has challenged the judgment and decree of first appellate court. A suuit for declaration, rectification and for permanent injunction filed by the plaintiff was dismissed by the trial court . However, in appeal, the learned first appellate court re-appraised the evidence and R.S.A.No.1563 of 2000 : 2 :
came to the conclusion that thte plaintiffs are joint owners in point possession to the extent of 8 bighas as per the sale deed Ex.P-1 and Ex.P-2.
However, claim for rectification was rejected by the first appellate court.
I have gone through the record of the case but find no material to hold that the findings recorded by the first appellate court suffer from any infirmity or are contrary to the record.
No question of law, much less any substantial question of law arises in the present appeal.
