The petitioner, whose husband was working as a Conductor and died in harness, approached this Court by way of CWP No.8282 of 2003, which was allowed by this Court on 16.8.2004 and a direction was issued to reimburse the amount incurred by the petitioner's husband for his treatment, within a period of six months.
Alleging non-compliance of the above said order, this contempt petition was filed in August 2005.
Unfortunately, this contempt petition could not be taken up for preliminary hearing.
Meanwhile, as stated by Learned Counsel for the petitioner, a part of the amount claimed by the petitioner has been released by the authorities concerned in October, 2005.
Having regard to the fact that a substantial part of the petitioner's claim has been satisfied, this petition is disposed of with liberty COCP No.950 of 2005 -: 2 :-
to the petitioner to make a representation, in respect of her remaining claims including interest on the delayed payments, to the General Manager, Haryana Roadways, Faridabad, with an advance copy thereof to the Transport Commissioner, Haryana, which may be sent by registered post.
The Officer presently posted as General Manager, Haryana Roadways, Faridabad, as well as the Transport Commissioner, Haryana are directed that on receipt of the said representation, the petitioner's remaining claim shall be objectively considered within two months of its receipt and if anything is found due, the same shall be disbursed to her within one month thereafter. However, if the authorities are of the opinion that the petitioner is not entitled to anything, the said information shall be communicated to her by passing a reasoned order within the above stipulated period.
