Civil Revision No. 2916 of 2005
Date of Decision: 5.9.2006
Jagdev Singh ---Petitioner
Baldev Raj ---Respondent
Coram: Hon'ble Mr. Justice Vinod K. Sharma Present: Mr. G.S.Nagra, Advocate,
for the petitioner.
Vinod K. Sharma, J. (Oral)
The present revision petition has been filed against the order dated 18.8.2003 passed by the learned Civil Judge, (Jr. Division), Anandpur Sahib, vide which the objections filed by the petitioner have been rejected on the ground that the executing court could not go behind the decree. The learned executing court rightly came to the conclusion that there were positive directions in the judgment that there was encroachment by the objector over the land. Therefore, the objections have rightly been rejected.
There is no illegality in the impugned order which may call for interference by this Court.
The revision petition is dismissed.
