Vide order dated May 1,2006, the main writ petition filed by the petitioner was disposed of. The matter was remanded back to the Chief Engineer (OP.), HVPN, Haryana, who is the appellate authority to re- decide the appeal filed by the petitioner within a period of three months from the date of appearance of the parties.

The present application has been filed by the applicant- respondents with the averments that the present Chief Engineer (OP.) DHBVNL, who has been directed to re-decide the appeal filed by the petitioner is Shri R.C.Sapra, who was a member of the raiding team which had inspected the premises of the petitioner-company, headed by Smt.Vanita Singh, Assistant Director(Vigilance) and had investigated the matter. In these circumstance, a prayer has been made that the appeal filed by the petitioner be directed to be heard by any other Chief Engineer in the interest of justice, equity and fair play.

After hearing the learned counsel for the parties and keeping in view the averments made in the application, we direct that the appeal of CM No.11018 of 2006 in

Civil Writ Petition No.16509 of 2003 2

the petitioner which had been remanded by this court vide order dated May 1,2006 shall now be heard by the Chief Engineer(OP.) DHBVNL, Hisar in terms of the aforesaid order dated May 1,2006.The aforesaid appeal shall be decided by the aforesaid Chief Engineer within a period of three months from the date of appearance of the parties before him.

A copy of the order be given dasti on usual charges.
