for the petitioner.
Petitioner Rajinder Singh alias Fauji apprehending his arrest in a non-bailable offence in case FIR No.87 dated 16.8.2006 registered under Sections 307/324/323/148/149 IPC read with Sections 25/27/54/59 of the Arms Act at Police Station Bareta, District Mansa, has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.
As per the prosecution version, the complainant was attacked by Piara Singh and Binder Singh besides the petitioner. The petitioner was armed with a gun and he exhorted other accused to kill the complainant and warned that if anybody attempted to save him, he would be killed. In this case, Binder Singh and Piara Singh inflicted kirpan blows to the injured.
Keeping in view the nature of the injuries and the manner in which the alleged crime was committed, I am not inclined to grant anticipatory bail to the petitioner.
