The petitioner has filed this petition under Section 482 Cr.P.C for quashing the complaint dated 27.11.2002 (Annexure P-1) filed by the respondent against the petitioner and the order dated 6.2.2006 (Annexure P-2) passed by the JMIC, Kurukshetra vide which the petitioner has been summoned to face trial for the offences under Sections 500/129B/323/506/153A/295-A IPC.
I have heard the counsel for the petitioner and perused the complaint as well as the summoning order. There are specific allegations in the complaint which constitute the alleged offence. After considering the specific allegations in the complaint and the preliminary evidence led by the complainant, the petitioner has been summoned by the JMIC, Kurukshetra to face trial for the aforesaid offences. I do not find any ground to quash the impugned orders only on the ground that the allegations are false. On this ground, at this stage, in my opinion, the complaint as well as the summoning order cannot be quashed.
