Dildar Singh v. State of Punjab & Ors - CWP-14620-2006 RD-P&H 6494 (5 September 2006)
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CWP NO. 14620 of 2006
DATE OF DECISION: 14.09.2006
Dildar Singh ....Petitioner
State of Punjab and others ....Respondents.
CORAM: HON'BLE MR.JUSTICE J.S. KHEHAR
HON'BLE MR. JUSTICE S.D. ANAND
PRESENT: Ms. Satpreet G. Kapila, Advocate for the petitioner.
J.S. Khehar, J. (oral)
Through the instant writ petition, the primary challenge raised is against the order dated 14.9.1999 (Annexure P1) vide which, on account of the absence of the petitioner for a period of 49 days, he has been denied salary for the days he was absent. It is not possible for us to entertain the instant writ petition at the present juncture, keeping in mind the fact that the impugned order was passed seven years before the filing of the instant writ petition. The instant writ petition is, accordingly, liable to be dismissed for reasons of delay and laches.
Even on merits, we find no justification for accepting the claim of the petitioner. It is not understandable how the petitioner can claim salary for the number of days on which he had remained absent from duty.
For the reasons recorded above, we find no merit in this writ petition. The same is, accordingly, dismissed.
