Petitioner Satnam Singh has filed this petition under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 182 dated 7.12.1999 under Sections 452, 506 IPC, registered at Police Station Division No.6, Jalandhar.

I have heard counsel for the parties and gone through the contents of the petition as well as the order dated 29.6.2006, passed by Additional Sessions Judge (Duty) Jalandhar, whereby bail application of the petitioner has been dismissed.

In the aforesaid case, the petitioner is in custody since 24.5.2006. Earlier, he was granted bail, but subsequently he did not appear and was declared proclaimed offender. Counsel for the petitioner contends that due to the prolonged illness of the mother of the petitioner and death of his elder brother, he could not appear before the trial court. He further contends that now the petitioner is ready to furnish heavy surety and give an undertaking that in future he will not absent.

Keeping in view the aforesaid facts and the custody period, without expressing any opinion on the merits of the case, I deem it appropriate to grant bail to the petitioner. He is, accordingly, ordered to be released on bail subject to his furnishing heavy surety to the satisfaction of the trial court.

Petition is allowed accordingly.
