Shanti Devi v. The State of Punjab - CRM-56199-M-2006 RD-P&H 6703 (7 September 2006)
CRL.MISC.NO.56199-M OF 2006
DATE OF DECISION: SEPTEMBER 14, 2006
The State of Punjab and others ....RESPONDENTS
CORAM: HON'BLE MR.JUSTICE SATISH KUMAR MITTAL
Present: Mr.Nakul Sharma, Advocate,
for the petitioner.
Petitioner Shanti Devi has filed this petition under Section 482 Cr.P.C for issuing direction to respondent No.1 to complete the investigation on the complaint (Annexure P-2) filed by the husband of the petitioner before the police. Earlier the petitioner had filed a petition for registration of a criminal case on the basis of the said complaint. The said petition was disposed of by this Court vide order dated July 7, 2006 passed in Crl.Misc.No.37378-M of 2006 with a direction to the Senior Superintendent of Police, Jalandhar to look into the complaint made by the petitioner and take action in accordance with law. In view of the said order, in my opinion, no further order is required in this case.
In case the police does not take any action in the matter, it will be open for the petitioner to take the alternative remedy available to her under the law as has been held by this Court in Mithlesh Kumari v. State of Punjab, 2002 (4) RCR (Criminal) 541 and by the Hon'ble Supreme Court in Gangadhar Janardan Mhatra v. State of Maharashtra and others, (2004) 7 SCC 768 and Minu Kumari and another v. State of Bihar and others, (2006) 4 SCC 359.
