Order.

This application has been filed with a prayer to modify the order dated July 5, 2006, vide which appeal filed by the appellant applicant was allowed and compensation amount granted for death of her husband was enhanced from Rs. 1,20,000/- to Rs. 1,62,000/-. In that judgment, it was further said that out of the amount enhanced, 50% would go to the appellant and remaining 50% would go to respondents No. 3 and 4, i.e., father and mother of the deceased respectively. With this application, death certificates of both the respondents have been placed on record. It has further been said that there is no other dependent /legal representative of deceased respondents No. 3 and 4. Application is accompanied by an affidavit. It is apparent from the records that respondents No. 3 and 4 remained satisfied with the CM No. 14034-CII of 2006 in

compensation, granted by the Motor Accidents Claims Tribunal, as they did not file any appeal. In view of their death during pendency of this appeal, this Court feels that only the applicant appellant is entitled to get the compensation amount. Accordingly, last paragraph of the judgment, referred to above, is modified and it is ordered that entire compensation be paid to the appellant in FAO No. 266 of 1988. Civil Misc. application stands disposed of accordingly.
