Ram Akshay Kumar v. State of Punjab & Ors - CWP-13680-2006 RD-P&H 6767 (8 September 2006)
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CWP NO.13680 OF 2006
DATE OF DECISION: 29.8.2006
Ram Akshay Kumar ...Petitioner.
State of Punjab and others ....Respondents.
CORAM: HON'BLE MR.JUSTICE J.S. KHEHAR
HON'BLE MR. JUSTICE S.D. ANAND
PRESENT: Mr.Akshay Kumar Goel, Advocate
for the petitioner.
J.S. Khehar, J. (oral)
In the instant writ petition, the petitioner has impugned the order dated 3.7.2006 (Annexure P8) vide which the name of the petitioner has allegedly been removed from the list of regularised employees working as skilled workers. The aforesaid order has been passed by specifically observing that the claim of persons, who are placed higher in the seniority list, was not considered for regularisation at the time when the petitioner as well as others similarly situated as the petitioner, were regularised as skilled workers.
In order to challenge the order dated 3.7.2006, it is emphatically pointed out that the petitioner was appointed as an unskilled worker, he has remained in the service of the respondents as an unskilled worker, and even today he is an unskilled worker.
If the factual position indicated by the petitioner is correct, we CWP NO.13680 OF 2006 2
are of the view that he should have no grievance against the order dated 3.7.2006, which merely withdraws regularisation (if any) as a skilled worker.
For the reasons recorded above, we find no merit in the instant writ petition. The same is accordingly dismissed.
