This is a petition under Section 438 of the Code of Criminal Procedure for bail in a case lodged under Sections 307, 324, 34 IPC and Section 27 of the Arms Act.
There are specific allegations against the petitioner that he fired from a short distance from his .12 bore gun on Hazara Singh and the pellet hit on the right shoulder and right arm and second shot fired at the complainant did not hit as he was lying down. Learned counsel appearing for the petitioner has relied upon the medical evidence to contend that the allegations of fire from short distance is not borne out as there is no blackening or tatooing.
This question cannot be gone into by this Court, while deciding the application for bail.
No ground for grant of anticipatory bail is made out.
Dismissed.
