This contempt petition has been filed alleging, inter alia, that in order to wriggle out of the compromise which was affected between the parties and is duly incorporated in the order dated 19.9.2003 passed by the learned District Judge, Ferozepur (Annexure P-4), the mutation No.17616 dated 15.6.2004 (Annexure P-6) has been erroneously got recorded by the private respondents in connivance with the Revenue Authorities, namely, respondent No.10. It is further averred that on the strength of wrongly entered mutation, efforts are being made to dispossess the petitioner.
Learned counsel for the petitioner, however, states that the above-mentioned mutation has already been impugned by the petitioner before an appropriate forum.
After hearing learned counsel for the petitioner, I am satisfied that no case to initiate the proceedings under the Contempt of Courts Act, 1971 against the respondents is made out.
Needless to say that if any party to the compromise acts contrary to agreed terms and conditions contained therein, there are more than one remedies available to the petitioner in law to seek enforcement of the said compromise. With liberty to avail any such remedy as may be available in law, this petition is disposed of.
