This revision petition is preferred against the order dated April 12, 2004 passed by the learned Additional District Judge, Kurukshetra whereby the petitioner was directed to affix court fee on valuation of Rs.16.5 lacs instead of the value of Rs.15 lacs of the subject property as mentioned in the 'agreement to sell' dated July 4, 1992.
Notice of motion was issued and in response thereto, the respondents have put in appearance.
Learned Senior Counsel representing the respondents fairly states that he does not oppose the prayer made in this revision petition as, according to him, the court fee affixed by the petitioner on the basis of the value of the property, depicted in the agreement to sell, was correct.
After hearing Learned Counsel for the parties and in view of Civil Revision No.2373 of 2004 -: 2 :-
the stand taken by Learned Counsel for the respondents, the revision petition is allowed; the impugned order dated April 12, 2004 passed by the Additional District Judge, Kurukshetra is set aside. Consequently, it is held that the court fee affixed by the petitioner on the basis of value of the property as mentioned in the agreement to sell dated July 4, 1992 is correctly affixed.
