This petition filed under Article 226 of the Constitution prays for issuance of direction to the respondents to release pensionary benefits of the petitioner along with interest @ 18% per annum. The petitioner has approached this Court without first approaching the respondents by filing a representation seeking enforcement of his legal rights. It has been asserted that the petitioner has retired from service w.e.f. 10.10.2005, vide order dated 10.8.2005. The file concerning his pension case is being sent forward and backward with one query or the other. However, at this stage without going into the merits of the controversy raised, we direct the Registry to sent five copies of the complete paper book of the writ CWP No. 14938 of 2006
petition along with copy of this order to the respondents who shall treat the same as a representation on behalf of the petitioner. The counsel for the petitioner shall deposit the process fee along with copies of the petition within one week from today. The respondents shall take a final decision on the grievance made by the petitioner in the instant petition within a period of two months from the date of its receipt. If the pecuniary benefits/pensionary benefits are found due, the same shall be released expeditiously to the petitioner without any delay along with permissible rate of interest.
