The present revision petition has been filed against the order dated 10-9-2003 passed by the learned Rent Controller, Jalandhar,vide which the leave to defend has been granted to the respondents herein.
The learned trial court has come to the conclusion that the application moved for leave to defend disclosed the facts entitling the respondents herein to contest the ejectment petition on merit.
Learned counsel for the petitioner contends that the summons were received by him which were not in the proper form and, therefore, the application moved by the respondents for leave to contest was beyond the period of limitation.
I have considered the submissions raised by the learned counsel for the petitioner and find no force in the same. The learned Court below which issued the summons was aware of the form in which the same were issued. Even by granting leave to defend to the respondents herein, no Civil Revision No. 5343 of 2003
prejudice has been caused to the petitioner. He can contest the claim on merits.
There is no error in the order which may call for interference by this Court.
