Petitioner Kuldeep Singh apprehending his arrest in a non- bailable offence in case FIR No. 102 dated 15.7.2006 under Sections 307/341/323/148/149 IPC, registered at Police Station Mehna District Moga has filed this petition under Section 438 Cr.P.C. for anticipatory bail.
I have heard counsel for the parties and gone through the contents of the FIR.
In this case, when the complainant was going to his village in a bus, the petitioner along with other persons stopped the bus and started beating the petitioner with dangs. Three injuries were caused, out of which one injury, which is grievous in nature (the arm of the complainant has been broken) has been attributed to the petitioner.
Keeping in view the nature of allegations against the petitioner and the manner in which the occurrence took place, I am not inclined to grant anticipatory bail to the petitioner.
