The petitioners have filed this petition under Section 482 of the Code of Criminal Procedure for quashing FIR No. 293 dated 10.11.2005 registered at Police Station Civil Lines, Batala, under Sections 498-A, 406 IPC along with all the subsequent proceedings arising out of the same.
2. The petitioners are seeking quashing of the aforesaid FIR on the ground that the allegations levelled by the complainant in the FIR regarding the demand of dowry and entrustment of the dowry articles are totally false and vague. It has been further alleged that the aforesaid FIR has been got registered by the complainant against all the family members of her husband.
3. I have heard counsel for the petitioners and gone through the contents of the FIR.
4. The allegations made in the FIR cannot be said to be vague. It also cannot be said that from the bare reading of the FIR, no offence is made out against the petitioners. As far as contention that these allegations are false is concerned, in my opinion, the correctness of the allegations is to be gone into at the time of trial on the basis of evidence. Thus, no case for quashing of the FIR is made out.
