Petitioner Karamjit Singh alias Raja has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.124 dated 16.5.2005 registered under Sections 302/201/120-B/34 IPC at Police Station Mahesh Nagar, District Ambala.
I have heard the counsel for the parties and gone through the contents of the FIR as well as the order dated 3.8.2006 passed by the Addl.Sessions Judge, Ambala.
In this case, the aforesaid FIR was registered on the complaint dated 16.5.2005 made by one Surjit Singh, who informed the police that an unknown person was lying dead near his fields. During the investigation, on 19.5.2005 the petitioner was arrested and on 20.5.2005 he suffered a disclosure statement stating his involvement in the crime and on the basis of the said statement, the purse, wrist watch and mobile phone of the deceased were got recovered from his residential house. In his subsequent disclosure statement dated 24.5.2005, he admitted his love affair with co-accused Babita, at whose asking, the aforesaid murder was committed. During investigation, the police has also confirmed the telephonic conversation made by the deceased as well as the petitioner and co-accused Babita.
In view of the aforesaid facts, no prima-facie case for grant of regular bail is made out.
