JUDGMENT :
The defendant Punjab State Electricity Board and others having concurrently lost before the two courts below, have approached this Court through the present appeal.
The plaintiff filed suit for declaration and for Mandatory Injunction claiming that she was entitled to family pension and the payment on account of the death of Amrik Singh, who had expired on April 28, 1978, while in service as Assistant Lineman.
Both the courts below have held it as a matter of fact that the services of the aforesaid Amrik Singh had been regularized from January 1969 to July 31, 1977 and therefore, on the date of his death, he had worked for 7 years and 5 months of regular service. The defence taken by the defendants that the service rendered by Amrik Singh did not entitle his heirs to any family pension, was rejected . The suit filed by the plaintiff was decreed and the appeal filed by the defendants failed before the first appellate court.
I have gone through the record of the case but find no material to hold that the findings recorded by both the courts below suffer from any infirmity or are contrary to the record.
No question of law, much less any substantial question of law arises in the present appeal.
Dismissed.
