The petitioner moved an application for getting Stage Carriage Permit on Talwara Ludhiana via Mukerian etc. route. In response to the publication made, inviting applications for grant of three stage carriage permits, 52 applications were received. No objection was filed against those applications. The State Transport Commissioner granted two permits to the existing operators and one was earmarked for new entrants, which was granted to respondent Nos.2 and 3. It is not in dispute that both the respondents, referred to above, are brothers, one of them is graduate and other is 10+2. Both are the holders of heavy transport vehicle licence. Both the authorities below have rightly held that the petitioner does not have better merits as compared to the respondent Nos.2 and 3. This Court feels that the orders passed are perfectly justified. No case is made out for interference.
