Concededly, the petitioner had filed an earlier writ petition bearing CWP No.14761 of 2004 claiming similar reliefs as have been claimed by it in the present writ petition. The aforesaid writ petition was withdrawn by the petitioner with a liberty to approach the respondents. No liberty had been ever sought, nor granted by this Court to the petitioner to approach this Court yet again claiming the said relief. In this view of the matter, we find that the present writ petition filed by the petitioner is not maintainable. Even otherwise, we are satisfied from the perusal of the impugned order Annexure P-7 that the Improvement Trust had informed the petitioner that the file of the land which according to the petitioner was allotted to the petitioner-Trust was not traceable. In these circumstances, the petitioner had to produce the requisite documents for taking any further C.W.P NO. 14595 OF 2006 2
action. The petitioner-trust claims that it had been allotted the plot in question, whereas the Improvement Trust is disputing the said fact.
In this view of the matter, the petitioner may seek its appropriate remedy before the Civil Court, if so advised.
Disposed of with the aforesaid liberty.
Copy of the order be given dasti on payment of the usual charges.
