Counsel for the respondents states that against the order Annexure P-11 and subsequent proceedings taken thereon, appeal/ application can be moved before the Debt Recovery Tribunal. Confronted with this situation, counsel for the petitioner, after arguing for some time, states that he be allowed to approach the Debt Recovery Tribunal.
Accordingly, this writ petition is disposed of with liberty to the petitioner to approach the Debt Recovery Tribunal. Interim stay, granted by this Court on June 12, 2006, shall continue for a period of 20 days from today. The petitioner may, in the meantime, file appeal/ application, as per law, before the Tribunal and may also move an application for stay, which shall be decided by the Tribunal without being influenced by the interim order, mentioned above. Shri Chatrath states that if the appeal/ application is filed within twenty days from today, the respondent Bank shall not raise any objection regarding limitation.
