This is second petition filed by petitioner Bittu Masih alias Ladi under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 188 dated 19.11.2003 under Section 15 of the NDPS Act, registered at Police Station Guhla, District Kaithal. His earlier petition was dismissed by this Court on May 08, 2006, while passing the following order :
"Petitioner Bittu Masih alias Ladi has filed this petition under Section 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No. 188 dated 19.11.2003 under Section 15 of the NDPS Act, registered at Police Station Guhla, District Kaithal.
I have heard counsel for the petitioner and gone through the contents of the FIR as well as the order dated 27.3.2006, passed by Judge, Special Court, Kaithal, whereby bail to the petitioner has been declined.
In this case, 200 Kgs. of poppy husk is alleged to have been recovered from the spot. Though the petitioner was not arrested at the spot, but he has been specifically named in the FIR. At this stage, I do not find any ground to grant regular bail to the petitioner.
Dismissed at this stage."
After hearing counsel for the petitioner, I do not find any fresh ground for the grant of bail to the petitioner.
Dismissed.
