The Food Corporation of India having concurrently lost before the two courts below, has approached this Court through the present appeal.
A suit for recovery of Rs.98,778.10 was filed by the plaintiff- Corporation claiming the aforesaid amount as damages allegedly sustained by the plaintiff-Corporation in a tender floated on July 11, 1984. Both the courts below concurrently found that there was no condition in the contract between the Corporation and the defendant-firm and in view of the aforesaid finding, the claim of the Corporation was rejected.
Nothing has been shown that the findings recorded by both the courts below suffer from any infirmity or are contrary to the record.
No question of law, much less any substantial question of law arises in the present appeal.
