Petitioner Ashok Kumar apprehending his arrest in a non- bailable offence in case FIR No.169 dated 14.6.2006 registered under Section 15 of the NDPS Act at Police Station Sadar, Rohtak, Distt.Rohtak, has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.

I have heard the counsel for the petitioner and gone through the contents of the FIR as well as the order dated 26.7.2006 passed by the Special Judge, Rohtak.

In this case, the petitioner was sitting in the vehicle and got injured also, and from the said vehicle 25 bags of poppy husk were recovered. In view of this fact, I do not find any ground to grant anticipatory bail to the petitioner.

Dismissed.
