Petitioner Rameshwar Giri, apprehending his arrest in a non- bailable offence in case FIR No. 121 dated 24.7.2004 under Section 365 IPC, registered at Police Station Focal Point, Ludhiana, has filed this petition under Section 438 of the Code of Criminal Procedure for the grant of anticipatory bail.
I have heard counsel for the parties and have gone through the contents of the FIR.
Counsel for the respondent-State, after having instructions from Desa Singh HC, states that in terms of the order dated May 23, 2006, the petitioner has joined the investigation and during the investigation, he has been found innocent by the Investigating Officer as well as by DSP of the concerned area.
In view of the above, without commenting on the merits, the interim bail, granted vide order dated 24.3.2006, is made absolute subject to the same terms and conditions.
Disposed of accordingly.
