The petitioners have filed the instant petition under Article 226 of the Constitution for quashing order dated 5.4.2004 (P-5) to the extent it reject their claim for regularisation of service on the ground that sanctioned posts are not available. A further prayer has been made to direct the respondents to regularise the services of the petitioners on the basis of policy instruction, dated 1.10.2003 (P-2) as well as in terms of the judgment of this Court passed in the case of Rajesh Kakkar and another v. State of Haryana and another (C.W.P. No. 9397 of 2004, decided on 7.4.2005), annexure P-7.
Having perused the pleadings made in the instant petition, we are of the considered view that no such directions could be issued for regularization of the services of the petitioners in view CWP No. 17667 of 2005
of the Constitution Bench judgment of Hon'ble the Supreme Court in the case of Secretary, State of Karnataka & others v. Umadevi & others, (2006) 4 SCC 1 as well as a detailed judgment of this Court in the case of Rajinder Kumar v. State of Haryana, 2006 (2) PLR 474.
Therefore, the instant petition fails and the same is dismissed.
