The challenge in the present revision petition is to the order dated 13.9.2006, passed by the learned trial Court, whereby an application filed by the plaintiff-petition for striking of defence of the defendants for not filing the written statement within 90 days, has been declined.
Learned trial Court has found that the defendants are widow and children of the brother of the plaintiff and were negotiating for compromise with the plaintiff which caused delay in filing the written statement. The learned trial Court has exercised its discretion on the basis of sound judicial principles.
I I do not find any illegality or irregularity in the orders passed by the Court below which may require any interference by this Court in exercise of its revisional jurisdiction.
Dismissed in limine.
