Baltej Singh v. P.S.E.B. & Ors - CWP-14994-2006 [2006] RD-P&H 7335 (15 September 2006)

In the High Court of Punjab and Haryana at Chandigarh

......

C.W.P. No.14994 of 2006

.....

Date of decision:22.09.2006

Baltej Singh

.....Petitioner

v.

P.S.E.B. and others

.....Respondents

....

Coram: Hon'ble Mr. Justice S.S. Saron

Hon'ble Mr. Justice P.S. Patwalia

Present: Mr. Rahul Chhatwal, Advocate for the petitioner.

......

S.S. Saron, J.

The petitioner seeks quashing of the order dated 7.9.2006 (Annexure-P.11) passed by the Chief Engineer/P&M, Punjab State Electricity Board, Ludhiana (respondent No.2) and the order dated 8.9.2006 (Annexure-P.12) passed by the Sub Divisional Officer, P.S.E.B., T.L. Sub Division, Muktsar (respondent No.4). The petitioner has been promoted from the post of Lineman to Junior Engineer. He was initially posted at Muktsar. Thereafter, he has been posted at Ludhiana by the impugned order.

Learned counsel for the petitioner contends that the transfer of C.W.P. No.14994/2006

[2]

the petitioner to Ludhiana is a mid-term transfer and is in violation of the instructions dated 6.1.2006 (Annexure-P.2) as also dated 1.6.2006 (Annexure-P.3) which impose a complete ban on the transfer of the employees.

Having given our thoughtful consideration to the contentions of the learned counsel for the petitioner, we find no merit in the same. The instructions issued by the Board for the transfer of its employees are for the internal management of its affairs and do not confer any legal right on an employee to stay at a particular station of his choice. Besides, the petitioner has been adjusted on his promotion.

In the circumstances, the writ petition is dismissed.
