Petitioner Balwinder Singh, apprehending his arrest in a non- bailable offence in case FIR No. 81 dated 1.6.2006 registered under Sections 420/171/120-B IPC, at Police Station City Tarn Taran, Police District Tarn Taran, has filed this petition under Section 438 of the Code of Criminal Procedure for the grant of anticipatory bail.

I have heard counsel for the parties and have gone through the contents of the FIR as well as the order dated 11.7.2006, passed by Additional Sessions Judge, Amritsar, whereby bail application of the petitioner has been dismissed.

In this case, on July 28, 2006, after hearing counsel for both the parties, the interim anticipatory bail was granted to the petitioner subject to his joining investigation.

Counsel for the petitioner states that in terms of the aforesaid interim order dated July 28, 2006, the petitioner has joined the investigation.

The State counsel after having instructions from HC Jaswinder Singh does not dispute this fact and further states that the petitioner is no more required for further investigation.

In view of the aforesaid facts, without commenting on the merits of the case, the interim bail, granted vide order dated July 28, 2006, is made absolute subject to the same terms and conditions.

This bail order shall remain in operation till the investigation culminates into filing of challan under section 173 Cr.P.C. except for material change in the circumstances. Thereafter the petitioner shall be entitled to the grant of regular bail by the trial court and the same shall further continue till conclusion of the trial on the conditions to be imposed by the court of competent jurisdiction.

Disposed of accordingly.
