Petitioner Kamaldeep Singh alias Goldy has filed this petition under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 114 dated 6.7.2005 under Sections 376, 506, 34 IPC, registered at Police Station Dehlon, Police District Jagraon.

2. I have heard counsel for the parties and gone through the contents of the FIR.

3. The petitioner is in custody since 30.5.2006. In the aforesaid FIR, it has been alleged by the prosecutrix that the petitioner along with two other persons, namely Pardeep Singh alias Mintoo and Gurjit Singh used to come to her house in absence of her husband and they misused her.

4. Counsel for the petitioner contends that no specific allegation of rape has been alleged against the petitioner. She further contends that co- accused Pardeep Singh alias Mintoo has been granted regular bail by this Court vide order dated August 10, 2006, passed in Crl. Misc. No. 39555-M of 2006 and accused Gurjit Singh has been granted anticipatory bail by this Court. Counsel further contends that trial in this case is not likely to conclude soon.

5. In view of the aforesaid facts and circumstances, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. He is accordingly ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial court.
