JUDGMENT
M.M. KUMAR, J (Oral)
The petitioners have filed the instant petition under Article 226 of the Constitution for quashing order Annexure P-2 vide which their claim for regularisation of service has been rejected. A further prayer has been made to direct the respondents to regularise the services of the petitioners and grant them the regular pay scale to the post in question on the principle of equal pay for equal work from the date of their initial appointments with all consequential benefits.
CWP No. 5388 of 2004
Having perused the record and hearing learned counsel for the respondents, we are of the considered view that no such directions could be issued for regularization of the services of the petitioners in view of the Constitution Bench judgment of Hon'ble the Supreme Court in the case of Secretary, State of Karnataka & others v. Umadevi & others, (2006) 4 SCC 1 as well as a detailed judgment of this Court in the case of Rajinder Kumar v. State of Haryana, 2006 (2) PLR 474.
Therefore, the instant petition fails and the same is dismissed.
