The petitioner has filed the instant petition under Article 226 of the Constitution for quashing orders dated 20.8.2003 (P-6) and 31.12.2003 (P-8) whereby his claim for regularisation of service has been rejected. A further prayer has been made to direct the respondents to regularise his services on the post of Road Roller Driver w.e.f. 31.1.1996 with all consequential benefits and payment of arrears with 18% interest, on the basis of policy instructions dated 7.3.1996 and 18.3.1996 (P-2 and P-3).

Having heard the learned counsel for the parties we are of the considered view that no such directions could be issued for regularization of the services of the petitioner in view of the Constitution Bench judgment of Hon'ble the Supreme Court in the case of Secretary, State of Karnataka & others v. Umadevi & others, (2006) 4 SCC 1 as well as a detailed judgment of this Court in the case of Rajinder Kumar v. State of Haryana, 2006 (2) PLR 474.
Therefore, the instant petition fails and the same is dismissed.
