JUDGMENT
Vide order, under challenge, application of the petitioner, to amend his plaint, was dismissed. It is apparent from the records that the suit is pending since the year 1998. Prayer, which the petitioner now intends to incorporate, by way of an amendment, was very much available with him when he filed the suit and furthermore if he is allowed to amend his plaint, at this stage, it will amount to starting the trial afresh. If any right has accrued to the petitioner, he may file a separate suit, if permissible, as per law.
Dismissed.
